摘 要:2020年底,中欧领导人共同宣布中欧投资协定如期达成。这一协定涵盖市场准入、公平竞争、可持续发展、争端解决等内容,并具有全面性、均衡性、互惠性、典范性等四大突出特点。欧盟理事会与欧洲议会的批准是中欧投资协定生效的必经程序;欧洲议会对协定审批程序的冻结,使其批准进程受阻。中欧投资协定的批准前景主要受制于欧盟各国的立场、欧洲议会的态度以及美国的干扰等因素。在中国对欧投资政治风险凸显的情势下,中欧投资协定可通过提升中欧投资关系互惠性、促使企业承担社会责任、约束欧盟外资监管行为等路径来化解这一政治风险。The leaders of China and the EU announced that the China-EU Comprehensive Agreement on Investment was reached at the end of 2020.This agreement covers market access,level playing field,sustainable development,and dispute settlement,etc and it is comprehensive,balancing,reciprocal and exemplary.The approval of the Council of the EU and the European Parliament is a necessary procedure for the entry into force of this agreement;the European Parliament’s freezing of this agreement hinders its ratification process.The prospect of ratification of this agreement mainly depends on the position of the EU members,the attitude of the European Parliament,and the interference of the US.Under the situation where the political risks of China’s investment in the EU are increasing,this agreement can mitigate these risks by enhancing the reciprocity of China-EU investment relations,urging companies to take social responsibility,and restricting the EU’s supervisory behavior towards FDI.
