摘　　要：[目的/意义]个人信息处理对于科学治理突发公共卫生事件具有极为重要的作用。然而,当前我国在应对突发公共卫生事件的过程中存在违法和不当处理个人信息的问题。基于此,对突发公共卫生事件中个人信息处理行为进行规制,并建立相应的信息安全保障机制具有重要价值和现实意义。[方法/过程]本文运用扎根研究方法识别突发公共卫生事件中个人信息处理行为所涉及的个人信息类型和个人信息处理者类型,对公民就个人信息处理行为的风险感知和影响公民接受个人信息处理行为意愿的客观因素进行分析,并提出完善突发公共卫生事件中个人信息处理行为规制规则和信息安全保障制度的策略。[结果/结论]我国立法应当进一步明确突发公共卫生事件中个人信息处理的原则与限制,通过赋予个人信息处理者信息安全保障义务,完善不当处理个人信息的法律责任等方式,实现对突发公共卫生事件中个人信息处理行为的有效规制及个人信息安全的充分保障。[Purpose/significance]The processing of personal information plays an extremely important role in scientific management of public health emergencies.However,there are problems of illegal and improper processing of personal information in the process of responding to public health emergencies in China.Based on this,it is of great value and practical significance to regulate personal information processing behaviors in public health emergencies and establish the corresponding information security protection system.[Method/process]This paper used grounded research method to identify types of personal information and personal information processors involved in personal information processing behaviors in public health emergencies,and analyzed citizens'risk perception of personal information processing behaviors and objective factors that affected citizens'willingness to accept personal information processing behaviors,and put forward strategies for improving the personal information processing behavior regulation rules and the information security protection system in public health emergencies.[Result/conclusion]The legislation in China should further clarify the principles and restrictions on personal information processing in public health emergencies,and by entrusting personal information processors with information security protection obligations and improving the legal responsibilities of improper personal information processing behaviors,so as to achieve effective regulation of personal information processing behaviors in public health emergencies and full personal information security protection.
