摘　　要：虽然《行政强制法》对行政强制措施的设定和实施程序作了详细规定,但现实行政执法中违法适用行政强制措施的现象仍然十分突出。在对现行立法进行规范分析的基础上,梳理行政强制措施的程序性适用条件以及建构实体性适用条件,可以明晰行政强制措施的程序性必要条件和选择条件,并以《行政强制法》第2条作为制度资源对行政强制措施进行类型重构,可以将行政强制措施分为违法制止型、证据保全型、危害防控型三大类型以及细化种类,从而提出各类行政强制措施的实体性必要条件和选择条件。Although“Administrative Enforcement Law”has made detailed provisions on the establishment and implementation procedures of administrative enforcement measures,the phenomenon of illegal application of administrative enforcement measures in administrative law enforcement is still very prominent.By combing the procedural application conditions and constructing the substantive application conditions of administrative coercive measures,this paper clarifies the procedural necessary conditions and selection conditions of administrative coercive measures on the basis of normative analysis of the current legislation,and reconstructs the types of administrative coercive measures with Article 2 of the“Administrative Enforcement Law”as institutional resources.The administrative coercive measures are divided into three types:illegal suppression type,evidence preservation type and harm prevention and control type.Finally,the substantive necessary conditions and selection conditions of various administrative coercive measures are put forward.
