论综合性党内法规制度的构建

摘　　要：“综合性党内法规制度”的概念早在中共中央1990年7月31日印发的《中国共产党党内法规制定程序暂行条例》中即被明确提出,但是并未加以界定和展开,特别是没有在党内法规制度体系中得到运用。但是,随着党内法规制度“1+4”体系一些问题的日益凸显,把“综合性党内法规制度”列入党内法规制度体系并赋予其应有的地位越来越重要。为此,要正确认识设置“综合性党内法规制度”的必要性,明确综合性党内法规制度的基本构成,其中《中国共产党党内法规制定条例》是最主要的综合性党内法规制度,而配套综合性党内法规制度和地方综合性党内法规制度也是其重要组成部分。在此基础上,要看到综合性党内法规制度在引领党内法规制度建设的基本方向和原则,规范党内法规制度的制定、修订和清理工作,协调不同党内法规制度之间关系等方面的重要作用。The concept of the“Party’s comprehensive disciplines and regulations system”was clearly put forward in the Interim Regulations on the Procedure of Making Inner-Party Rules and Regulations of the Communist Party of China(CPC)issued by the CPC Central Committee on July 31,1990,but it has not been defined and developed,worse still not applied in the inner-Party rules and regulations system.However,with the issues of the“1+4”system of the Party’s internal legal system growing increasingly prominent,it becomes more important to include the“comprehensive inner-Party legal system”in the system of the Party’s internal legal system and give it due status.It is therefore necessary to correctly understand the importance of the“Party’s comprehensive disciplines and regulations system”and clearly define the basic structure of inner-Party rules and regulations,“Ordinance for the Making of CPC Inner-Party Rules and Regulations”being of the primary importance,and other supporting comprehensive inner-Party and local rules and regulations proving to be indispensable components.On this basis,we should see that the comprehensive inner-Party legal system has the basic direction and principle of leading the construction of the Party’s internal legal system,regulating the formulation of the Party’s internal legal system,revising and cleaning up the work,and coordinating the relationship between the different Party’s internal legal system.
