摘 要:《民法典》与藏族习惯法价值目标一致,具体规则竞合较多,但多不冲突,且《民法典》承认藏族习惯法的法源地位,因而能够有效地消弭其与藏族习惯法的冲突。《民法典》弘扬社会主义核心价值观,在涉藏地区社会治理中,其能够柔性引导藏族习惯法,有效凝聚民族共识,增强民族向心力。各组织、团体应依托优势资源成立宣讲团,精研宣讲内容,特别注重《民法典》政治意义及相较于藏族习惯法的优势方面的宣传,以深入浅出、生动有趣的方式进一步引导藏族民众主动学习、运用《民法典》。The Civil Code and the Tibetan customary law have the same value goals.There are many overlapping specific rules,but most do not conflict.Moreover,the Civil Code recognizes the status of Tibetan customary law as the source of law,so it can effectively eliminate the conflict between national law and Tibetan customary Law.The Civil Code,promoting the core values of socialism,can flexibly guide Tibetan customary Law,effectively build national consensus,and enhance national centripetal force in the social governance of Tibet-related areas.Organizations and groups should rely on advantageous resources to set up propaganda groups,study the content of the propaganda,and pay more attention to the political significance of the Civil Code and its comparative advantages upon Tibetan customary laws,guiding Tibetan to learn and use the Civil Code in a vivid and interesting way.
