摘  要:近年来,随着现代生活节奏的加快,越来越多的消费者选择以网络购物替代传统的线下购物,而网购的特性决定了消费者和商品之间势必存在一定的距离,无法直接接触商品,只能通过商家展示的宝贝详情和已经购买过商品的买家评价来判断商品的好坏,大部分消费者更加信任后者,认为买家的评价更能展现商品。基于此,某些电子商务经营者采取虚假交易方式,制造虚假的商品评价以实现更好的销量。这种虚假交易行为侵犯了消费者的知情权,虽然我国已经出台相关法律对该行为进行规制,但这些规定较为笼统,实际操作性不强。本文通过对虚假交易行为进行理论分析,提出对消费者知情权进行保护的路径。In recent years,with the acceleration of the pace of modern life,more and more consumers choose to replace the traditional offline shopping with online shopping,and the characteristics of online shopping determine that there is bound to be a certain distance between consumers and goods,because they can not directly touch the goods,instead,they can only judge the quality of goods through the goods details displayed by businesses and the evaluation of buyers who have purchased the same goods.Most consumers trust the latter and think that the buyer's evaluation is more able to show the quality of goods.Based on this,some e-commerce operators take the way of false transactions to create false commodity evaluation,in order to achieve higher sales.This kind of false trading behavior infringes the consumers’rights to know.Although China has issued relevant laws to regulate this behavior,these provisions are general and not practical.Based on the theoretical analysis of false trading behavior,this paper puts forward the paths to protect consumers’rights to know.
