摘　　要：国际海洋规则制定能力主要表现为影响国际海洋规则内容的能力,受创制能力、整体实力和领域优势等多种因素影响。海洋综合实力是国际海洋规则制定能力的物质保障,国际海洋规则制定能力可以为海洋综合实力在全球海洋治理中发挥积极作用提供制度保障。在构建包容性海洋秩序时代,提升国际海洋规则制定能力是海洋强国建设的着力点。全球海洋治理法治化也迫切要求海洋强国提升国际海洋规则制定能力。新时期我国海洋强国建设应将国际海洋规则制定能力纳入海洋强国指标体系,有效参与并引领国际海洋规则制定,增强涉海议题设置、议程把控以及方案设计能力,通过密切关注国际海洋实践,对重要的海洋法理论前沿问题进行跟踪性研究,尽快组建稳定且精通国际海洋法的专业人才队伍。The capacity to make international ocean rules is mainly manifested as the ability to influence the contents of international ocean rules.Comprehensive marine strength is the foundation for making international ocean rules,and the capacity of making international ocean rules provides an institutional guarantee for comprehensive marine strength to play its active roles in global ocean governance.In the era of establishing an inclusive ocean order,to increase the capacity to make international ocean rules is the focus of building a maritime power.The rule of law in global ocean governance has also forced maritime powers to improve their abilities of making international ocean rules.In the new era,China’s construction of a maritime power should include international ocean rules making capacity into an index system of building a maritime power.We should participate in and play a leading role in international ocean rules making,enhance the abilities of marine-related agenda setting and control,and plan designing,make a tracking study on frontier issues in international law of the sea by following international marine practice,and form a stable team of talents steeped in international law of the sea as soon as possible.
