摘 要:随着我国经济的高速发展,劳动争议案件的总量居高不下,劳动者败诉的案件逐渐增多,劳动者和用人单位的矛盾得不到有效缓解。现阶段劳动争议处理制度在新形势下存在一些问题,对保护劳动者的利益有诸多不利因素。文章提出优化劳动争议处理制度的方案,对解决劳动争议案件具有更合理的处理机制、更充实的理论基础、更完善的法律依据,以充分保护劳动者的合法权益。With the rapid development of China’s economy,the total number of labor dispute cases is high,while the number of cases in which workers lose is increasing.The contradiction between workers and employers cannot be effectively alleviated.Present labor dispute processing system in the new situation has some problems,thus protecting the interests of laborers has many unfavorable factors.This paper puts forward the optimization of labor dispute processing system,which has a more reasonable handling mechanism,a fuller theoretical basis and a more perfect legal basis for the settlement of labor dispute cases,fully protecting the legitimate rights and interests of workers.
