摘 要:从《老年人权益保障法》第二十六条到《民法总则》第三十三条,再到《民法典》第三十三条,意定监护制度逐渐走进了国民的视野,这也预示着我国的成年监护体系朝着更加多元化、弹性化的方向演进。但由于意定监护制度在中国施行时间并不长,而现行法律对于此制度的适用又过于原则概括,缺乏具体的可操作步骤,因此需要秉持“私法自治”理念,通过明确意定监护协议、建立意定监护统一公证制度、设定监督机制等方式完善意定监护制度。From Article 26 of the Law on the Protection of the Rights and Interests of the Elderly,to Article 33 of the General Principles of the Civil Law,and then to Article 33 of the Civil Code,the voluntary guardianship system has gradually come into the view of the people,which also indicates that China’s adult guardianship system is evolving towards a more diversified and flexible direction.But due to the practice of the guardianship system in China is not long,and the current law for this system is summarized,the principle lacking specific operational steps,so we need hold on the idea of“private law autonomy”,by defining the guardianship agreement by agreement,establish the guardianship unified by notary system,and set up supervision mechanism to perfect it.
