条约法视阈下上合组织打击“三股势力” 违法犯罪法律制度研究

摘　　要：在以往的预防和打击“三股势力”违法犯罪合作中,上海合作组织已经在某些法律制度建设及制度的落实方面取得了举世瞩目的成绩。文章通过对60个相关条约的结构和内容进行分析,首次从法学角度对预防和打击“三股势力”的一般制度和特殊制度进行了界定,并分析说明了它们各自所包含的具体内容及已经取得的成效。但是,伴随着新问题、新矛盾的出现,一方面为该组织预防和打击“三股势力”违法犯罪合作提供出了更大的延伸空间,另一方面也预示着更大的挑战和压力,需要各成员国摒弃杂念,坚守“上海精神”,共同开创防控“三股势力”违法犯罪合作的新局面。In the past cooperation on the prevention of and crackdown on crimes committed by the"three forces",SCO has made remarkable achievements in the construction of certain legal systems and their implementation,some of which are exemplary to a certain extent.By analyzing the structure and contents of 60 relevant treaties,this paper defines the general system and special system of preventing and combating the"three forces"from the perspective of law,and analyzes their specific contents and achievements.The emergence of new problems and new contradictions become extended areas for the Organization to prevent and combat the"three forces"crimes,and also pose greater challenges and pressures for SCO,which requires member states to stick to the"Shanghai spirit"and to jointly create a new chapter in preventing and combating the"three forces"crimes.
