法律视域下我国体育博彩风险评估与体系重构

摘　　要：在海南自由贸易区建设的推动下,我国体育博彩迎来了发展的新机遇。由于监管架构、立法体系滞后,我国体育博彩发展面临法律风险。认为:我国可围绕《彩票法》建立具有稳定性、预见性、前瞻性的法律体系,妥善审理新型案件;平衡体育博彩监管部门权力分配,加强跨部门、跨领域、跨国界的协同合作;进行体育行业自治,构建多方共治机制,创造良好的法治环境;通过道德激励、道德教育等方式向大众传授伦理、道德、竞技精神,潜移默化地培养正确的价值观和道德选择能力。Driven by the construction of Hainan Free Trade Zone,China's sports lottery has ushered in new opportunities for development.However,due to the tardy regulatory framework and legislative system,the development of sports lottery in China is facing great legal risks.It is suggested that:a stable,foreseeable,and prospective legal system around the Lottery Law can be established so as to properly handle new types of cases;the power distribution of sports lottery regulatory authorities should be balanced and cross-departmental,crossdomain and cross-border collaboration should be strengthened;a multi-party co-governance mechanism with the assistance of the sport autonomy should be built to create a good legal environment.The moral impetus and the moral education are adopted to cultivate people's values and moral selection ability through teaching them ethics,morals and competitive spirit.
