摘　　要：乡村旅游是在农民土地的基础上开发的。近年来,国家和地方政府都在积极出台相关政策,鼓励农民进行土地流转,这些政策有利地刺激了乡村旅游业的发展。各个地方由于实际情况不同,选择了不同的旅游开发模式,产生了不同的土地流转模式。通过对土地流转进行理论辨析,以商洛市为例,分析不同土地流转模式下的法律问题和法律困境,提出乡村旅游开发中预防土地流转问题的法律路径,对提高土地利用率,保障农民的合法权益,增加农民收入具有重要意义。Rural tourism is developed on the basis of farmers'land.In recent years,national and local governments are actively introducing relevant policies to encourage farmers to carry out land transfer.These policies are beneficial to stimulate the development of rural tourism.Due to the different actual situation,different places have chosen different tourism development models,resulting in different land transfer models.Through the theoretical analysis of land circulation,taking Shangluo City as an example,this paper analyzes the legal problems and legal dilemmas under different modes of land transfer,and puts forward the legal ways to prevent the problem of land circulation in the development of rural tourism,which is of great significance to improve the utilization rate of land,protect farmers'legitimate rights and interests and increase farmers'income.
