“裸聊”类敲诈勒索犯罪的特点、根源及防控--以131例相关刑事案件为样本的分析

摘　　要：当前,我国“裸聊”类敲诈勒索犯罪案件频发。通过裁判文书网对131份“裸聊”类敲诈勒索犯罪刑事裁判文书进行整理并对公安实践中接触到的“裸聊”类敲诈勒索犯罪被害人、犯罪嫌疑人进行分析,发现“裸聊”类敲诈勒索犯罪呈现出犯罪地区分布广泛、犯罪金额两极分化明显、犯罪主体多为中青年的低学历人群等特征。为有效防范此类犯罪的发生,公安机关等有关部门应考虑采取加强法治宣传教育,提升公民防范意识和能力,同时强化网络平台运营的监管力度等措施,严厉打击“裸聊”类敲诈勒索犯罪,营造绿色安全的网络环境。At present,China s“naked chat”type of extortion crimeis frequent.We sorted out 131 criminal judgment documents of“naked chat”,a kind of extortion crime,and analyzed the victims and suspects of“naked chat”that came into contact with the public security practice through the judgment document network.It is found that the“naked chat”is characterized by a wide distribution of crime areas,obvious polarization of crime amount,and mostly young and middle-aged people with low educational backgrounds.In order to effectively prevent the occurrence of such crimes,public security organs and other relevant departments should consider taking measures such as strengthening the publicity and education of the rule of law,enhancing citizens awareness and ability of prevention,and strengthening the supervision of online platform operation,so as to prevent and control the“naked chat”crimes and create a safe online environment.
