刑事一体化视野下高校刑法学研究生课程的体系构建——基于五所政法院校的实证考察

摘　　要：目前,高校刑法学研究生课程体系设置存在理论性有余而实务性不足的缺陷,并局限于刑法学科内部研究刑法,忽略了与其他法学科领域以及法学之外的其他人文社会科学的联结。“科际鸿沟”导致研究生教育过程中理论研究的局限性、司法判断的片段性以及人才培养的狭隘性之弊端凸显,刑法硕士人才陷入理论能力弱于刑法博士,而实务技能又逊于法律硕士的窘境。以刑事一体化理论及其衍生的关系刑法论思想为基础,探求理想的刑法研究生课程体系构建,成为科学的人才培养机制的重要组成部分。对此,应当顺应社会对于刑法学人才的实际需求,疏通学科樊篱,实现科际整合,增强刑法学术人才的综合技能培养,完善刑事学科体系内部结构设计,重塑刑法学科与其他学科体系的外部关系,构建科学完整的、层次鲜明的刑法学研究生课程体系。At present,the graduate curriculum system for criminal law in colleges and universities is more theoretical than practical,which is confined to the disciplinary study of criminal law,exhibiting a disregard for its connection to other disciplines of law and other humanities and social sciences outside the discipline of law.The“interdisciplinary gap”leads to the increasingly prominent drawbacks involving the limitation of theoretical research,the fragmentation of judicial judgment,and the narrowness of talent training in the process of postgraduate education.The talent of the master of criminal law fall into a dilemma where their theoretical skills are weaker than that of the doctor of criminal law,while their practical skills are weaker than that of the master of law.Based on the theory of integration of criminal justice and the theory of relationship-based criminal law derived from it,this paper explores the construction of an ideal graduate curriculum system for criminal law,which has become an important part of the scientific talent cultivation mechanism.In this regard,the author of this paper suggests to conform to the actual needs of the society for criminal law talent,removing the disciplinary barriers,realizing interdisciplinary integration,enhancing the comprehensive skills training of criminal law academic talents,improving the internal structure design of criminal discipline system,reshaping the external relationship between criminal law discipline and other discipline systems with the purpose of constructing a scientific,complete and stratified graduate curriculum system for criminal law.
