一起变造动物检疫证明案件的评析与思考

摘　　要：2019年10月接A市农业综合行政执法大队电话反映,有一辆装有30头生猪的货车上携带的《动物检疫合格证明》疑似造假。经案件移送、立案调查,认定行政相对人韩XX、侯XX变造动物检疫证明的违法事实清楚、证据确凿,按照《动物防疫法》第七十九条之规定,对当事人韩XX、侯XX给予了25000元罚款的处罚决定。本文对被处罚主体适格、违法事实认定、法律条款适用及关联线索调查等关键要素进行评析,对关联案件移送、调查方法采用、联合执法应用等内容进行了探讨,以期为类似案件的查处提供参考。In October 2019,the author received a telephone call from the Agricultural Comprehensive Administrative Law Enforcement Brigade of City A to report that the animal quarantine conformity certificate carried on a truck with 30 pigs was suspected to be fake.After the case was transferred and filed for investigation,it was found that the illegal facts and evidence of the administrative counterpart Mr.Han and Mr.Hou altering the animal quarantine certificate were clear and conclusive.In accordance with Article 79 of the Animal Epidemic Prevention Law,the party Mr.Han and Mr.Hou were fined 25000 yuan.This paper evaluates and analyzes the key elements such as the eligibility of the punished subject,the identification of illegal facts,the application of legal provisions and the investigation of related clues,and discusses the transfer of related cases,the adoption of investigation methods and the application of joint law enforcement,in order to provide reference for the investigation and handling of similar cases.
