浦东新区自然人流动高水平开放亟需解决的法律问题

摘　　要：推动自然人流动便利化、自由化,是落实《关于支持浦东新区高水平改革开放打造社会主义现代化建设引领区的意见》,助力我国服务贸易水平提高的重要举措之一。然而,随着开放水平的不断提高,自然人流动规制体系中存在的法律问题愈发成为阻碍。未来可从由行政驱动转向立法驱动、将高水平开放作为政策导向、填补法律规则中的空白、解决现行制度中的冲突、简化外国人来华程序、完备国外职业资格认可制度等方面,推动浦东新区自然人流动的高水平开放。Promoting the facilitation and liberalization of the movement of natural persons is one of the important measures for the improvement of trade in services in China and for the implementation of the Opinions on Supporting the High-level Reform and Opening-up of the Pudong New Area and Creating a Leading Area for Socialist Modernization.However,as the level of opening-up has been improved continuously,the legal issues under the movement of natural persons are exposed gradually.To promote the high-level opening-up of movement of natural persons in the Pudong New Area,some attempts can be made including promoting the changes of movement of natural persons by legislation rather than administration;taking the high-level opening-up as the legal foundation;filling the gaps of laws and rules;solving the conflicts between the rules;simplifying the regulatory procedures;recognizing foreign vocational qualification certificates.
