摘　　要：通过溯源和比较的方法,对卫生行政处罚中受理和立案的来源进行探究,对其他行政执法部门中受理和立案进行比较分析,总结了卫生行政处罚中受理和立案的法理基础和实践做法,分析了受理和立案在实践中被过度弱化和过度强化的根源,提出受理和立案在规范行政执法、明确执法责任制和有利行政执法统计等方面的基本功能,也提出了重新构建受理和立案制度,以适应新时代卫生行政执法形势需求的构想。Through the method of tracing and comparing,the source of acceptance and registration of health administrative punishment is explored.Furthermore,by comparing and analyzing the acceptance and registration in other administrative law enforcement departments,the legal basis and practice of acceptance and registration of health administrative punishment is summarized,and the essential reason of excessive weakening and over strengthening of acceptance and registration practice is also analyzed.Finally,the fundamental function of normalizing administrative law enforcement,clarifying law enforcement responsibility and facilitating administrative law enforcement statistics is proposed,and the idea of reconstructing the acceptance and registration system is also proposed,which aims at the futural requirements of health administrative law enforcement.
