医疗卫生法的本位论:后疫情时代的法理与导向

摘　　要：我们正在经历前所未有的疫情时代,下一步必将进入一个充满不确定性的"后疫情时代"。在"后疫情时代",人类的生存和健康将被摆在首要席位。不言而喻,医疗卫生法将被提升为最受关注的研究领域,不过对此我们尚未具备足够的理论支撑、制度体系及未来发展导向。因此,我们应该立足于医疗卫生法的本位论和类型化并重新界定其理论基础,统一和整合相关名称和概念,以便使医疗卫生法理论研究和制度实践进入全面发展轨道,在此基础上前瞻性地综合考量后疫情时代的发展方向。We are experiencing an unprecedented epidemic era,and the next step is bound to enter a "post-epidemic era" full of uncertainties.In the "post-epidemic era", the survival and health of mankind will be given top priority.It goes without saying that medical and health law will be promoted as the most concerned research field.However,we do not yet have sufficient theoretical support,institutional system and future development guidance for this.Therefore,we should base on the standard theory and typology of the medical and health law and redefine its theoretical basis,unify and integrate related names and concepts,so that the theoretical research and system practice of the medical and health law can enter the comprehensive development track,and look forward on this basis.Comprehensively consider the development orientation of the post-epidemic era.
