《医疗事故处理条例》修订之思考

摘　　要：《医疗纠纷预防和处理条例》第五十五条规定"对诊疗活动中医疗事故的行政调查处理,依照《医疗事故处理条例》的相关规定执行"。这一规定进一步明确了《医疗事故处理条例》作为各级卫生行政部门对医疗行业和医疗市场、医疗质量和医疗安全等进行行政监管的职能。但实践中,一方面由于社会主要关注的是医疗纠纷的民事处理问题,而《医疗事故处理条例》中涉及的医疗纠纷预防、医疗纠纷民事处理、医疗纠纷的技术鉴定、医疗纠纷民事赔偿标准等内容与现行法律中有关医疗纠纷的预防和处理的规定不一致。另一方面《医疗事故处理条例》在对医疗机构和医务人员的行政监管方面远没有发挥其应有的作用。为了更好发挥《医疗事故处理条例》行政监管职能,强化医疗事故对医疗机构和医务人员行政监管的作用,故有必要对《医疗事故处理条例》进行相关内容的修订。结合工作实际提出对其修订之思考,以期供决策者参考。Article 55 of Regulations on Prevention and Handling of Medical Disputes stipulates that "the administrative investigation and punishment of medical accidents in diagnosis and treatment activities shall be carried out in accordance with Regulations on the Handling of Medical Accidents".This regulation clarifies the functions of Regulations on the Handling of Medical Accidents as the administrative supervision of the medical industry and medical market,medical quality and medical safety.But in practice,the prevention of medical disputes,civil treatment of medical disputes,technical appraisal of medical disputes,civil compensation standards of medical disputes and other contents in the Regulations on the Handling of Medical Accidents are inconsistent with the provisions of the current laws and regulations on the prevention and treatment of medical disputes.At the same time,the Regulation on the Handling of Medical Accidents has not played its due role in the administrative supervision of medical institutions and medical personnel.In order to give full play to the administrative supervision function of Regulations on the Handling of Medical Accidents and strengthen the role of medical accidents in the administrative supervision of medical institutions and medical staff,it is necessary to revise elevant contents of Regulations on the Handling of Medical Accidents.Based on the actual work,the authors put forward some thoughts on the revision of the Regulations on the Handling of Medical Accidents,so as to provide reference for decision makers.
