摘 要:集装箱超期使用费纠纷是近年来在国际贸易中一种占比较高的纠纷类型。无论国际和国内,学界、业界及司法实践对此存在不同观点及做法,进而导致贸易商在实务操作中无章可循。此类纠纷涉及集装箱超期使用费的性质、计算标准、索赔人及责任人等争议,而贸易商通常成为承担责任的主体。特别是当收货人拒绝提货或无人提货时,出口商则可能成为责任人;当同时存在契约托运人与交货托运人两个不同托运人时,他们可能构成共同的责任人,进而承担集装箱超期使用费。对贸易商而言,此类纠纷是一种耗费精力、增加法律及经济成本的风险。探讨如何降低成本,规避风险,防患于未然,具有重要的理论和现实意义。Container detention charges disputes are a type of dispute that occurs frequently in international trade in recent years.Either at home and abroad,there are different views and practices on it in the academic community,the industrial community and the juridical practice.It is turned out that there has been no principle to follow in the practice.The disputes involve the nature,basis of calculation,the claimant,subject of liabilities for compensation of the detention charges.But the exporter&importer are usually subject of liabilities for compensation.Especially when the consignee doesn.t pick up the goods or no one picks up the goods,the exporter is subject of liabilities for compensation.When there are contract shipper and practice shipper,they may be the subject of liabilities for compensation concurrently.This will burn the candle at both ends,cause economic&law cost increasing for traders.It has a positive theoretical and practical significance to discuss how to reduce the cost,avoid the risk,and take all measures to prevent any potential risk.
