试论我国知识产权领导协调机制之完善

摘　　要：知识产权领导协调机制是推动我国知识产权治理现代化进程的关键。尽管我国已建立“国务院知识产权战略实施工作部际联席会议制度”,并在国家知识产权战略实施过程中发挥了重要作用,但现行知识产权领导协调机制在层级和权威性上仍有所欠缺,亟待“升级换挡”,以与即将启动实施的国家知识产权强国建设战略相匹配。借鉴日本和韩国的实践经验,建议将现行国务院知识产权战略实施工作部际联席会议升格为国家知识产权战略委员会,由国家领导人担任委员会负责人,并由相关部委负责人、产业界和学术界代表担任成员。同时,可通过知识产权基础性立法为新的国家知识产权领导协调机制提供法治化保障。The leading and coordinating mechanism of intellectual property is the key to the promotion of the modernization of intellectual property governance in China.Although China has established the system of“the State Council Inter-ministerial Joint Conference on the Implementation of the National Intellectual Property Strategy”,which has played an important role,there are still some deficiencies in the current leading and coordinating mechanism of intellectual property.It needs to be“upgraded”in order to match with the national strategy of reinvigorating China through intellectual property rights,which will be launched soon.The practical experience of Japan and South Korea suggests that the current“the State Council Inter-ministerial Joint Conference on the Implementation of the National Intellectual Property Strategy”ought to be upgraded to the national intellectual property strategy committee,of which the national leaders as the head,the leaders of relevant ministries and commissions,and the industry and academic representative experts as the members.At the same time,it provides the legal guarantee for the new leading and coordinating mechanism of intellectual property of the state level with the fundamental legislation.
