“共同富裕”作为宪法社会主义原则的规范内涵

摘　　要：宪法中出现50次的"社会主义"一词并非内容空洞的修饰语,而是具有特定价值意涵的原则规范。基于文义、体系和历史解释,"社会主义"作为我国宪法基本原则的规范地位,应在学理上予以明确。对其规范内涵的建构,可以在理论论证层面引入"共同富裕"观。以促进有尊严的人类生活为目标的"社会平衡"理念是现代各国宪法的社会国、社会主义等原则的稳定内核,而"共同富裕"是其中国表达。"共同富裕"理念的"富裕"和"共同"两个侧面在我国现行宪法中都有表达,历次宪法修改也体现了侧重上的微调。以社会平衡、共同富裕为要义的社会主义原则,对于整个法律体系都具有价值贯彻和规范诫命的意义,对"民主""市场经济""法治"等都有实质性限定,对包括民法、社会法、税法等在内的整个法律体系都有系统性调整的要求。但是应注意,"共同富裕"的规范展开,必须与宪法同样保护的自由、人权、民主、市场等价值相协调。The"socialism"that appears 50 times in the Chinese Constitution is not a rhetorical term,but a fundamental norm with specific values.With textual,systematic and historical approaches,socialism can be interpreted as a fundamental principle in the Constitution,which shall be clarified and emphasized at the academic level.To construct the nature and meaning of socialism,the term of"common prosperity"is very helpful.In the worldwide,the concept of"social balance"that aims to promote human dignity is an essential part of important constitutional principles,such as social state and socialism."Common prosperity"is its counterpart in the Chines Constitution."Common"and"prosperity"can both be found in the texts of the current constitution.These two words were slightly evolved in the past constitutional amendments.Socialism with the core of social balance and common prosperity,is the cornerstone of the Chinese legal system.It substantially defines the meanings of democracy,market economy and the rule of law in China,and influences the substances of civil law,social law and taxation law.However,an academic analysis of"common prosperity"shall be coordinated with other constitutional principles,such as freedom,human rights,democracy and market.
