摘 要:随着经济发展,我国游艇数量迅猛增长,游艇引发的事故层出不穷。游艇投保率低,受损方往往难以获得救济。引入游艇第三者责任强制保险可有效保护受损方利益,分散游艇业主风险,降低政府管理难度,达到维护公共利益、促进行业健康发展的目的。国内外已有的海上强制保险、道路交强险以及港澳游艇第三者责任强制保险等成熟的强制责任保险经验为我国引入相关制度提供了借鉴。基于强制责任保险的法定性、强制性、公益性及便利性等对我国引入该制度在立法、制度设计方面提出了建议。With the development of economy,the number of yachts in China has increased rapidly,and the accidents caused by yachts occur frequently.The insurance rate of yachts is low,and it is often difficult for the injured party to obtain relief.The introduction of compulsory insurance for the third-party liability of yachts can effectively protect the interests of the injured party,relieve the risks of yacht owners,reduce the difficulty of government management,and achieve the purpose of safeguarding public interests and promoting the healthy development of the industry.The mature compulsory liability insurance at home and abroad,especially the experience in road traffic insurance and the third-party compulsory insurance for yachts in Hong Kong and Macao,provides reference for the introduction of relevant systems in China's Mainland.Based on the legitimacy,coerciveness,public welfare and convenience of compulsory liability insurance,this paper puts forward suggestions on the introduction of the system in terms of legislation and system design.
