摘　　要：截至2020年12月31日,最高人民法院已发布26批共计147例指导性案例。本文以147例指导性案例作为研究对象,以“北大法宝-司法案例库”中的裁判文书作为数据样本,使用大数据分析的方法,从多种维度对指导性案例发布和应用情况进行应用及比较研究。报告还围绕指导性案例的发布和应用案由、地域、审理法院,援引类型及应用结果进行了具象化分析,综述中通过数据来反映指导性案例的发布和应用现状,以呈现2020年度指导性案例司法应用的变化,为我国指导性案例的司法应用发展提供参考。As of December 31,2020,the Supreme People’s Court had issued 147 guiding cases in 26 groups.Using the 147 guiding cases as the subject of research and the adjudicative instruments in the PKULAW.CN Judicial Case Database as data samples,this paper studies the application and conducts a comparative research on the issuance and application of guiding cases from various angles through big data analysis.Concretization is applied in this report to the analysis of the causes of action,territories,and trial courts in the issuance and application of guiding cases,as well as invocation types and results of application,and the conclusion part contains data that refl ects the current status of issuance and application of guiding cases,to show changes in the application in judicial proceedings of guiding cases in 2020 and provide references for the development of application in judicial proceedings of guiding cases in China.
