摘　　要：本文通过对视频分享网站注意义务的考察,提出注意义务的固定判定标准和浮动判定标准,并结合我国司法实践,重点分析“避风港”规则。在视频分享网站著作权侵权纠纷的审理过程中,程序规则也是保障权利人实体权利实现的重要一环,司法实践对此存在诸多争议。本文结合实体问题和程序问题,围绕若干法律适用问题进行研究,勾勒出审理此类案件的基本思路。In recent years,local courts,especially those in developed areas,pay more attention to the study of similar cases.With the development of social economy,the copyright infringement case of video sharing website has become one routine case in the type of cases.This article investigates the duty of care of video sharing websites,proposes the fixed standard and floating standard of duty of care,and emphatically analyses the“Safe Harbor”principles.In the trial of video sharing website infringement disputes,the rule of procedure is an important part in guaranteeing the realization of the substantive rights.There are many disputes about these rules in judicial practice.This article combines the substantive and procedural questions,focuses on the application of law,outlines the basic ideas of hearing such cases.
