摘　　要：我国代表制度的法理基础体现在两方面:一是通过党代表“人民”与人大代表“公民”形成双重代表关系,二是在“公共利益”机制下衍生出公民政治权利。实质法治要求下的民主建设需要便捷的民意表达机制,人大代表制度中的程序民主机制建设是关键。现代技术内嵌于人大代表制度可实现“连线民主”与精准民意表达,新技术应用可以优化人大制度中的代表关系,并且新技术应用可以让“公共利益”、“公民权利”等问题具备公开化、民主化的可操作性。新时代条件下需要充分利用现代技术手段来完善人大制度的程序性民主机制,可分别在人大代表选举程序、代表与被代表公民之间的联系程序、会议程序及人大监督程序中以技术为切入点进行制度完善。Perfecting the system of people’s congresses has a bearing on the interests of the whole people.Under the system of People’s Congress,which“upholds the leadership of the Party,the people are the masters of their own affairs and the rule of law is organically unified.”The legal basis is firstly the dual mode of representing the“people”by the Party and the“citizen”by the deputies to the People’s Congress.Secondly,the civil and political rights are derived from the power form of the“public interest”,and under the democratic requirements of the substantive rule of law.The establishment of convenient and quick public opinion expression mechanism is the key to the democratic procedure of the People’s Congress in the new era.Modern technology embedded in the system of people’s congress can realize“wired democracy”with accurate expression of public opinion.The introduction of new technology can optimize the generation of people,and the two Representative Assembly System in relational tables,and the application of new technology can make the“public interest”and“civil rights”problem can be open for operation of democracy.The new conditions of the times have supplied a possibility for the full use of modern technology to improve the People’s Congress System of procedural democracy mechanisms,respectively in the procedures for the election of deputies,the contact procedure between the citizens and their deputies,congress procedure and supervision procedures.
