摘　　要：近年来,我国公共卫生事件的频发对人们的身心健康产生了不利影响,也进一步对社会和经济发展构成了巨大的威胁,引起了人们的关注。突发公共卫生事件可以说是与人民的生命财产安全息息相关,政府行政机关有尽最大努力预防和管理各种突发公共卫生事件并减少损失的义务。在应对突发公共卫生事件过程中形成的行政应急权利给行政机关在应对公共危机时提供了强有力的支撑。但是,从目前情形出发,在突发公共卫生事件中政府的行政部门在具体使用行政应急权利时仍存在诸多问题。现从这个角度出发,探讨行政紧急权利的适用,并针对存在的问题提出相应意见和建议。In recent years, the frequent occurrence of public health incidents in our country has adversely affected people’s physical and mental health. It has also further posed a huge threat to social and economic development and has attracted people’s attention. Public health emergencies can be said to be closely related to the safety of people’s lives and property. Government administrative agencies have the obligation to do their utmost prevent and manage various public health emergencies and reduce losses. The administrative emergency power formed in the process of responding to public health emergencies provides strong support for administrative agencies in responding to public crises. However, as far as the current situation is concerned, there are still many problems in the use of administrative emergency power by government administrative departments in public health emergencies. This paper will discuss the application of administrative emergency right from this perspective, and put forward corresponding opinions and suggestions for the existing problems.
