人权视角下的2021版《世界反兴奋剂条例》修改

摘　　要：采用文献资料法等,对2021版《世界反兴奋剂条例》修订内容中涉及到的兴奋剂管制、教育研究2个部分及《反兴奋剂运动员权利法案》、《隐私与个人信息保护国际标准》2个文件的相关内容进行研究。可以发现:2021版《世界反兴奋剂条例》再次沿用了人权原则,从实体权利和程序权利2个方面强化对运动员各项合法权利的保护,还通过对规则的调整提高了人权原则在反兴奋剂治理各个阶段的适用程度。通过从程序上和实体上分别研究新条例的修改内容,领悟其对人权、健康等精神的弘扬,并在对规则解读的基础上提出完善建议,推进世界反兴奋剂治理进程。Using the method of literature review,this paper makes analysis on two parts of doping control,education and research involved in the revised content of the 2021 World Anti-Doping Code,and the two documents of Anti-Doping Charter of Athlete Rights and the International Standard for Protection of Privacy and Personal Information.The result shows that the 2021 World Anti-Doping Code again follow the principles of human rights,strengthening the protection of the legal rights of athletes from two aspects:substantive rights and procedural rights,it has also improved the application of human rights principles in all stages of anti-doping governance through adjustments to the rules.Through the procedural and substantive research on the revised content of the new regulations,we can comprehend its promotion of human rights,health and other spirit,and put forward perfect suggestions based on the interpretation of the rules to promote the world anti-doping governance process.
