摘　　要："海洋命运共同体"理念与国际海洋技术转让规则在增进海洋福祉、实现海洋共治、深化务实合作等方面具有契合性。但由于各国技术水平和利益需求的差异,国际海洋技术转让规则在发展中面临重重困难,将其置于"海洋命运共同体"理念下进行审视,会发现许多问题值得反思,涉及价值共识、责任共担、利益共享等。国际海洋技术转让规则应以"海洋命运共同体"理念为指导,正视知识产权公共利益属性、拓展和完善技术转让模式、落实"特殊技术"转让的强制性义务。The concept of"Maritime Community witha shared Future"and the international rules for the transfer of marine technology correspond to each other in respects of enhancing marine well-being,realizing joint governance of the oceans and deepening practical cooperation.However,the rules of international marine technology transfer are facing many difficulties due to the differences in technology level and interest demand of different countries.If examiningthe rules of marine technology transfer under the concept of"Maritime Community witha shared Future",we will find many problems that deserve rethinking,including value consensus,responsibility sharing,interest sharing and so on.The rules of international marine technology transfer should be perfected under the guidance of the concept of"Maritime Community witha shared Future"and face up to the public interest of intellectual property rights,expand and improve the technology transfer mode,carry out the compulsory obligation of"special technology"transfer.
