摘 要:随着教育法治的推行、学生权利意识的提高以及"人本教育"思想的兴起,高校学生纪律处分行使的正当性遭遇到前所未有的挑战。应肯定高校学生纪律处分权的正当性,并始终将其界定为校内惩戒行为。走出当前工具性价值的片面追求、法纪不分的混沌局面和行政规制的不当窘境,正确处理好约束与保护、遵守与超越、限制与自由的关系,应以制度创新为基础,坚守纪律处分的育人性质;以过程优化为重点,凸显纪律处分的育人价值;以环境改善为保障,防范纪律处分的"滥用"或"怠用",从而构建起以人为本、科学严谨的高校学生纪律处分制度,最大限度实现教育性价值,以促进立德树人目标之达成。With the implementation of the rule of law in education,the improvement of students’awareness of rights and the rise of the thought of"humanistic education",the legitimacy of college students’disciplinary action has encountered an unprecedented challenge.We should affirm the legitimacy of the college students’disciplinary power and always define it as disciplinary behavior in school,get out of the current one-sided pursuit of instrumental value,the chaotic situation of non-separation of law and discipline and the improper dilemma of administrative regulation,and correctly deal with the relationship between restraint and protection,compliance and transcendence,restriction and freedom.We should adhere to the educational nature of disciplinary action on the basis of system innovation,focus on process optimization to highlight the educational value of disciplinary action,take the improvement of the environment as the guarantee to prevent the"abuse"or"neglect"of disciplinary action so as to build a people-oriented,scientific and rigorous disciplinary action system for college students,maximize the educational value to promote the achievement of the goal of moral education.
