摘　　要：《民法典》第359条对住宅建设用地使用权自动续期制度的规定做了补充,这一制度对于人民的生存权利具有重要意义,但目前的规定还较为笼统,因此应该对其进行细化并作出进一步解释。住宅建设用地使用权的自动续期制度具有社会保障的性质,其适用对象仅限于居住目的的土地使用权,但对居住目的的判断标准难以确定,因此该制度的适用应当设立个人保障面积标准,以保障续期制度的公平性。此外,还应当通过目的解释和体系解释,让自动续期制度能够更好地适用于实践。Article 359 of the Civil Code makes a supplement to the provisions of automatic renewal of the right to use land for residential construction,which is of great significance to the people′s right to live.However,since this current regime are relatively general,it is essential to refine it and give further explanations.The automatic renewal of the right to use land for residential construction has the nature of social security.Although its application is limited to the land use right for residential purposes,it is difficult to determine the criteria for judging the residential purpose.Therefore,the standard of a maximal area for personal use should be established to ensure the fairness when this regime is applied.In addition,the interpretation of purpose and system should also be adopted to make this regime more applicable in practice.
