未成年人刑事责任年龄调整之预防目的与衡平价值——以《刑法修正案(十一)》为切入点

摘　　要：《刑法修正案(十一)》关于未成年人犯罪年龄的修改引人瞩目。通过阐明"以特别残忍手段致人重伤造成严重残疾"以及"情节恶劣"等限定条件的内涵,可以发现其立法的合理性依据。第一,反映了法律本身应该具有的客观规律性;第二,反映出刑法坚持主客观相统一且向客观主义倾斜的立场;第三,充分体现了刑法法益保护机能和自由保障机能的协调统一;第四,说明中国法律因时而制、日趋具有传承性和包容性。The amendment of the criminal law amendment(11) on the age of juvenile delinquency has attracted people’s attention.By clarifying the connotation of “serious injury and serious disability caused by particularly cruel means” and “bad circumstances”,we can find the reasonable basis of its legislation.Firstly, it reflects the objective regularity that the law itself should have;Secondly, it reflects that the criminal law adheres to the unity of subjectivity and objectivity and tilts towards objectivity;Thirdly, it fully embodies the coordination and unity of the protection function of criminal law legal interests and the protection function of freedom;Fourthly, it shows that the Chinese law is time-based, increasingly inherited and inclusive.
