摘  要:随着集体建设用地使用权流转探索的不断深入,因不规范流转所产生的纠纷、问题日益增多。其中,村集体经济组织未经民主议定程序与其他民事主体签订合同,出让集体建设用地使用权,司法实践中法院对此类合同效力认定不一。现因旧村改造村集体经济组织可主张协商收回土地,合同相对方则可主张相应赔偿。With the deepening exploration of the transfer of collective construction land use right, there are more and more disputes and problems caused by non-standard transfer.Among them, the village collective has signed contracts with other civil subjects without democratic negotiation procedures to transfer the use right of collective construction land.In judicial practice, the courts have different opinions on the effectiveness of such contracts.Now, due to the transformation of the old village, the village collective can claim to recover the land through negotiation, and the opposite party of the contract can claim corresponding compensation.
