摘　　要：未成年被害人保护是刑事诉讼人权保障和惩罚犯罪理念的必然要求。随着现代社会对未成年人健康成长环境的重视和对犯罪行为惩治的全面化展开,构建一项对未成年被害人心理和精神双重保障的赔偿制度不仅在理性上是正当的,在现实中也是必需的。环顾世界法治发达国家,心理治疗、精神损害赔偿在刑事诉讼中早已经成为保障被害人民事权益的重要途径,适当借鉴并建立这一制度正逢其时。应当及时构建和完善一种基于严格未成年人保护立场的未成年被害人心理治疗和精神损害赔偿制度。The protection of the minor victims is the inevitable requirement of the human rights protection and the idea of punishing crimes in criminal proceedings.With the modern society paying more attention to the healthy growing environment of the minor and carrying out the punishment of the criminal act in an all-round way, it is not only rational to construct a system of compensation for the mental and spiritual double protection of the minor victims, but also is necessary in the real world.Looking around the world’s developed countries under the rule of law, psychotherapy and mental damage have long been important ways to protect the rights and interests of the victims in criminal proceedings.Under the background of promoting the comprehensive rule of law in China, it is high time to appropriately draw lessons from and establish this system.In view of this, it is necessary to construct and perfect a system of psychological treatment and mental damage compensation for minor victims based on the strict protection of minors in a timely manner.
