摘 要:当前广播影视作品呈现出社会需求激增化、类型多样化以及供给产业化态势,在规制广播影视业过程中面临着发展繁荣与潜藏风险并存的社会环境。广电总局应依据环境变迁修正规制举措,在坚持广播影视的根本性和方向性的前提下,侧重激发市场活力、促进行业繁荣、统筹风险防范。通过完善行业标准,采取分级制度,提升中性和柔性规制举措的使用比例,探索迈向多元主体共治下的合作行政模式,实现广播影视业行政规制的法治重塑,促进广播影视业健康有序发展。At present,the radio,film and television works show a trend of rapid social demand,diversified types and industrialization of supply.In the process of regulating the radio,film and television industry,the radio,they are facing a social environment of development,prosperity and potential risks.The State Administration of Radio,Film and Television(SARFT)should revise regulatory measures according to environmental changes,and focus on stimulating market vitality,promoting industry prosperity and coordinating risk prevention on the premise of adhering to the fundamental and directional nature of radio,film and television.In order to realize the legal reshaping of the administrative regulation of radio,film and television industry,and promote the healthy and orderly development of radio,film and television industry,it is vital to improve industry standards,adopt a grading system,increase the proportion of neutral and flexible regulatory measures,and explore a co-cooperative administrative model under the governance of multiple subjects.
