摘　　要：遏制虐童是各国面临的共同难题。域外相关国家或地区法治实践经验丰富,形成了一套有效的法律规范或制度机制,为我国保障儿童最大利益的刑事法治改革提供了有益启示。以《儿童权利公约》生效30周年为契机,在国家尊重和保障人权的宪法原则指导下健全防治虐童罪行的制度机制,可谓人权保障水平提升和刑事法治能力建设的关键。为此,我国应积极汲取域外相关经验,在现有的刑法和体制框架下,织密规制虐童的刑法网格,严格划清有关儿童权利边界,认真落实儿童最大利益原则,积极探索完善家庭、社区、教育或司法机构的权力监督制约制度。Curbing child abuse is a common issue faced by all countries.In this regard,relevant foreign countries have rich experience in the practice of the rule of law,which has formed a set of effective legal norms or institutional mechanisms,providing useful inspiration for the criminal rule of law reform to protect the best interests of children in China.On the occasion of the 30th anniversary of the entry into force of the Convention on the Rights of the Child,improving the institutional mechanism for the prevention and control of child abuse under the guidance of the constitutional principle of respecting and protecting human rights is the key to the improvement of the level of human rights protection and the capacity-building of the rule of criminal law.Hence,China should actively draw from useful experience of foreign counties,strictly regulate the criminal law grid of child abuse under the existing criminal law and institutional framework,define the boundaries of children’s rights,and conscientiously implement the principle of serving the best interests of children.China needs to actively explore and improve the power supervision and restriction system of families,communities,education or judicial institutions to that end.
