摘　　要：作为环境法体系的新兴领域,生态区域保护法的法典化需求与路径有待明确。目前,生态区域保护法作为自然生态保护法的体系定位日益清晰,具有调整目标的生态性、调整对象的区域性与调整方式的综合性,正在逐渐形成“一般生态区域法+特殊生态区域法”的基本构造。生态区域保护法的实然与应然之间尚存差距,亟需立法完善,但目前的分散性立法模式难以克服立法碎片化问题,需要转向法典编纂模式来获取内容全面性、逻辑自洽性、价值一致性等方面的体系化效益。为了充分实现法典编纂的体系化效益,生态区域保护法的法典化需要合理确定应纳入的疾律规范内容范围、协调与相关单行法的外部关系、安排内部的逻辑主线与结构,以及设计集中体现法典模式优势的重点制度。As an emerging field of environmental law system,the demand and path of codification of eco-regional protection law should be clarified At present,the positioning of eco-re-gional protection law as a part of natural ecological protection law is becoming clearer.Eco-re-gional protection law has ecological targets,regional objects and comprehensive methods,as well as a basic structure of"general eco-regional law+special eco-regional law".There is a gap between what is in practice and what should be in the eco-regional protection law,showing an urgent need for legislative improvement.However,the current decentralized legislative model cannot overcome the problem of legislative fragmentation,therefore it is necessary to turn to the codification model to obtain the benefits of systematization in terms of comprehensiveness,logical self-consistency and.value consistency.In order to fully realize the systemic benefits of codification,the codification of eco-regional protection law needs to reasonably detennine the scope of legal norms to be included,coordinate the external relations with relevant individual laws,arrange the internal logical main lines and structure,and design the characteristic systems that intensively reflect the advantages of the codification model.
