《著作权法》第三次修订对我国文化娱乐行业的影响

摘　　要：第三次《著作权法》修订对我国著作权法律制度进行了较大规模的修订和完善,其必将会对我国文化娱乐行业的发展产生重大影响。一是对著作权的权利客体及内容进行了扩张,新增作品法律定义,修改作品类型,扩大财产性权利内容,满足了新技术发展的要求;二是对著作权及相关权利的归属和利用的规则进行了完善,修改著作权管理制度,引入著作权登记制度,新增关于职务表演的规定,革新合作作品的行使规则,保障了著作权的交易安全,提高了著作权权利利用效率,促进了文化娱乐产品的传播;三是对著作权的司法保护进行了强化,扩大录音制作者和广播组织的权利范围,延长摄影作品的保护期,新增权利使用费作为赔偿数额计算方式,大力提高法定赔偿的数额,使文化娱乐行业有了更好的司法保障。The third amendment to the Copyright Law has made large-scale revision and improvement on our legal system for copyright and is bound to exert a great influence on the development of the culture and entertainment industry in China.The amendment includes the following three aspects:Firstly,the amendment has expanded the objects and contents of copyright thereof,added new legal definitions of the works,modified types of the works,and expanded the contents of property rights,which meet the requirements for the development of new technology.Secondly,the amendment has improved the rules on the ownership and utilization of copyright,revised the copyright administration system,introduced the copyright registration system,added the provisions on the performance in the course of employment,and updated the rules on the exercise of the works in collaboration,which guarantee the security of copyright transaction,improve the utilization efficiency of copyright and promote the communication of culture and entertainment products.Thirdly,the amendment has strengthened judicial protection for copyright,enlarged the scope of rights of recording producers and broadcasting organizations,and extended protection term of photographic works.Royalties have been newly introduced as a method for calculating the amount of compensation and the amount of statutory compensation has been greatly increased,all of which provide better judicial protection for the culture and entertainment industry.
