重大行政决策听证制度的有效性之实现路径探索

摘　　要：重大行政决策听证制度的有效性在于兼顾了公共利益与个人利益的平衡,实现了程序正义与实体正义,故而有助于实现科学决策、民主决策以及依法决策等价值与功能。当前,我国重大行政决策听证制度的有效性还存在参与主体资格不规范、听证中的沟通不理性以及听证后的回应机制不健全等诸多缺憾,从而阻滞了重大行政决策听证制度有效性的价值与功能的充分发挥。因此,如何实现重大行政决策听证制度的有效性已成为当下亟需解决的一个重大课题。重大行政决策听证制度有效性的实现路径主要应展现为三个向度:听证前的参与主体资格制度建设是实现重大行政决策听证制度有效性的前提;听证中的理性沟通制度建设是实现重大行政决策听证制度有效性的核心;听证后的回应制度建设是实现重大行政决策听证制度有效性的关键。The effectiveness of the hearing system of major administrative decision-making lies in taking into account the balance between public interest and individual interest,realizing procedural justice and substantive justice,and thus helping to the realization of such values and functions as scientific decision-making,democratic decision-making and decision-making in accordance with the law and so on.At present,there are still many shortcomings in the effectiveness of the hearing system of major administrative decision-making in our country,such as the non-standard qualification of the participants,the irrational communication in the hearing and the imperfect response mechanism after the hearing and so on,which hinders full employment of the value and function of the effectiveness of the hearing system of major administrative decision-making.Therefore,how to realize the effectiveness of the hearing system of major administrative decision-making has become a major issue that needs to be solved urgently.The realizing path of the effectiveness of the hearing system of major administrative decision-making should be shown as three degrees:the construction of the qualification system of the participating subject before the hearing is the prerequisite for the effectiveness of the hearing system of the major administrative decision-making;the construction of the rational communication system in the hearing is the core of the effectiveness of the hearing system of the major administrative decision-making;the construction of the response system after the hearing is the key to realizing the effectiveness of the hearing system of major administrative decision-making.
