摘 要:学界对学术自由权的界定莫衷一是,究其根源,是对学术本身理解的差异。学术自由权的权利构成也随之存在一定的争议,学术自由权是特定人群的奢侈品,还是普罗大众共享权利的争论依稀可闻。学术自由权有学术伦理的内在界限与宪法其他追求价值的外在界限。这些基本范畴的厘清,对系统解释我国宪法中的学术自由权有所裨益,不单单是个别条款,而是以47条为支点结合其他宪法关联条款作整体框架解读。The academic field has different definitions of the right to academic freedom.The root cause is the difference in the understanding of the academic itself.There are also some controversies about the right of academic freedom in view of constitution.The debate about whether academic freedom is a luxury for a specific group of people or whether it is shared by the general public is vaguely heard.The right of academic freedom has the internal limits of academic ethics and the external limits of other pursuits of value in the constitution.The clarification of these basic categories is beneficial to the systematic interpretation of the academic freedom in our country's constitution.It is not just an individual clause,but an overall framework interpretation of the 47 clause in the constitution to be combined with other related clauses.
