摘 要:选取1985-2020年相关政策法律文本,运用政策量化分析方法,检视中国工业固体废物(以下简称"工业固废")的规制路径。分析认为,国内工业固废治理在不同阶段一直以命令控制型工具规制为主,但资源化利用规制刚性明显不足;激励型工具相对充足,但有效性和政策落地存在诸多阻碍;引导型工具相对欠缺,与生态文明建设中的"多元共治"目标及理念存在较大差距。"十四五"期间是全面提升我国工业固废资源化利用水平的关键期,需针对上述问题调整优化规制工具。By conducting a quantitative analysis of texts, China’s existing policies and laws for regulating industrial solid waste treatment from 1985 to 2020 were reviewed, and the following conclusions were obtained: The treatment of industrial solid waste in China has long been dominated by the regulation pattern of command-control type of tool at different stages, while the resource utilization regulation has been obviously insufficient. Incentive tools have been relatively sufficient, but with obstacles in terms of effectiveness and policy implementation. Guidance-type tools have been fairly insufficient, much far from the goal and concept of "multi-players’ governance" advocated in line with the construction of ecological civilization. As the 14 th Five-Year Plan period is a critical time for comprehensively upgrading the level of resources utilization of industrial solid waste in China, it is necessary to address the above issues and further improve the relevant regulatory tools.
