摘　　要：所有制和产权的关系一直都是中国农地制度变迁中的两个核心命题。基于将"产权纵向独立性统摄下进行产权横向清晰化"的分析框架,才能深刻理解中国共产党百年来关于农村土地产权变迁的政策议程与成功经验。从"单一产权"到"三权分置"的动态演进,在纵向上坚持集体土地所有制统摄下,通过地权细分和强化农民的土地产权,究其实质就是通过产权横向清晰化以拓展土地产权权能,进而通过"赋权增能"于农民,实现农地"三重复合功能"下"秩序—公平—效率"的统一,满足农业现代化发展适度规模经营的需要。基于此,未来农村土地产权变迁应继续沿着"产权纵向独立性统摄下进行产权横向清晰化"这一逻辑主线演进,基于乡村振兴的战略目标渐进重构农地产权制度,最终走出一条独具中国特色的产权道路。The relationship between ownership and property rights has always been two core propositions in the change of China’s agricultural land system.Based on the analytical framework of"horizontal clarity of property rights under the control of vertical independence of property rights",we can deeply understand the policy agenda and successful experience of the Communist Party of China on the change of rural land property rights in the past century.The dynamic evolution from"single property right"to"separation of three rights"adheres to the control of collective land ownership vertically,subdivides and strengthens farmers’land property rights through land rights.Its essence is to expand the power of land property rights through horizontal clarity of property rights,and then realize"order,fairness and efficiency"under the"triple composite function"of agricultural land through"power empowerment"to meet the needs of moderate scale operation in the development of agricultural modernization.Based on this,the future changes of rural land property rights should continue to evolve along the main logical line of"horizontal clarity of property rights under the control of vertical independence of property rights",gradually reconstruct the rural land property rights system based on the strategic goal of rural revitalization,and finally develop a property rights road with unique Chinese characteristics.
