摘　　要：中国传统史学历史悠久、渊源有自,形成了独特的叙事方式和话语体系,通过史家的书写彰显儒家传统中的重要价值观念。《晋书·刑法志》的法典叙事主要体现了儒家的正统性观念,以儒家礼刑相须的礼法关系思想叙述魏晋时期的法典沿革史,具有为唐代法典接续历史源流的重要现实目的。同时,儒法合流的历史叙事话语一方面展现了儒家君臣职分的礼法观念和法中求仁的刑罚理念,另一方面则充分记叙了法家的形式主义法理观念以及对于刑罚变革应该贴合社会现实的务实态度。透过《晋书·刑法志》的历史叙事,不仅可以加深关于传统法理观念的理解,同时有助于我们重新思考当下关于法典编纂的历史叙事,为法典化的中国法治实践提供传统资源借鉴。In China,traditional historiography has both a long history and solid origin,giving rise to a unique narrative style and discursive system,which highlights significant Confucian values through the writing of historians.The legal code narration of The Book of Jin:The Treatise of Criminal Law mainly reflects the orthodox concept of Confucianism.It describes the evolution history of the law in the Wei and Jin dynasties with the Confucian thought of the relationship between rites and punishments,which has an important practical purpose for the continuation of the historical origin of the law in the Tang Dynasty.Meanwhile,the historical narrative discourse of the confluence of Confucianism and Legalism,on the one hand,demonstrates the Confucian concept of rites and laws of monarchy and the punishment concept of seeking benevolence in law,and on the other hand,it fully narrates the formalist legal concepts of Legalism and the practical attitude that the reform of penalties should conform to the social reality.Researching on the historical narrative of The Book of the Jin:The Treatise of Criminal Law can not only contribute to the understanding of the traditional juridical values,but also help us to rethink the current historical narrative about the codification of codes,and provide traditional resources for reference in the practice of codified Chinese rule of law.
