摘 要:《刑法修正案(十一)》增设"高空抛物罪"是我国刑法积极参与社会治理的又一例证,立法机关增设该罪是基于我国目前的社会生活条件、司法实践的现状以及刑法教义学的理论成果作出的理性选择,不能将之视为情绪性立法。《刑法修正案(十一)》生效后,高空抛物罪与以危险方法危害公共安全罪具有交叉竞合关系,部分产生侵害不特定或多数人法益具体危险的高空抛物行为仍然应当以"以危险方法危害公共安全罪"定罪处罚。高空抛物罪中的"情节严重"属于内涵不清的综合评价要件,应当基于自由主义刑法的"法益保护主义"以及"并合刑主义"对之作出限制性解释,将抽象危险犯不利于法治的消极影响降到最低。The addition of " throwing form high-altitude crime" in the Criminal Law Amendment(11) is another example of China’s Criminal Law actively participating in social governance, and the addition of the crime by the legislature is a rational choice based on the current social living conditions, the current situation of judicial practice and the theoretical achievements of criminal law doctrine, which cannot be regarded as emotional legislation. After the entry into force of the Criminal Law(Amendment 11), the crime of throwing from high-altitude has a cross-competition relationship with the crimes against public security by dangerous means, and some acts of throwing from high-altitude that give rise to the specific danger of violating legal benefits of non-specific or majority should still be convicted and punished as "crimes against public security by dangerous means". The "serious circumstances" in the crime of throwing from high-altitude belong to the comprehensive evaluation elements of unclear connotation, and we should make restrictive interpretations based on the "legal benefit protectionism" and "co-executionism" of liberal criminal law, so as to minimize the negative impact of abstract dangerous crimes that are not conducive to the rule of law.
