对工程造价领域行政规范的分析与改革建议——以《建设工程工程量清单计价规范》(GB 50500-2013)为例

摘　　要：行政规范是我国工程造价体系的重要组成部分,是工程预算、财政审核、政府审计的主要依据,亦是民商事争议解决中裁判者对建设工程案件结算、造价鉴定问题作出裁判的重要依据,对工程造价行业的发展起到了积极作用。但随着市场经济的深入,政府提出“减少政府对市场形成造价的微观干预”的改革目标,这些规范已不能完全满足市场的专业化与多元化要求。文章从工程造价改革的视角,通过分析行政规范与立法、民商事裁判的关系,分析造价与质量、安全的关系,提出关于行政规范改革的具体建议,采取以行业协会作为主体、以示范规范作为具体形式,以增加各类规范的包容度与弹性为目标,弱化行政管制、尊重市场等措施,以期将我国工程造价规范打造成为国际化通行标准之一,率先在粤港澳大湾区实现建设工程造价咨询市场的融合。Administrative norms are an important part of China's engineering cost system,and the main basis for the project budget,financial audit and government audit.It is also an important basis for the judges to judge the construction project case settlement and cost appraisal problems in the settlement of civil and commercial disputes,which plays a positive role in the development of the project cost industry.However,with the development of the market economy,the government has put forward the reform goal of"reducing the micro-intervention of the government in the formation cost of the market",and these norms can no longer fully meet the requirements of specialization and refinement of the market.From the perspective of engi-neering cost reform,the article analyzes the relationship between administrative norms and soon,and puts forward specific suggestions on administrative norms.We should take industry associations as the main bodyand take demonstration and norms as the concrete form.At the same time,in order to build China's engineering cost norms into one of the international common standards,we should weaken administrative control and respect the market,whichmay take the lead in realizing the integration of the construction project cost consulting market in the Guangdong-Hong Kong-Macao Greater Bay Area.
