“三权分置”下土地产权结构性交易对企业农地流转合约稳定性的影响研究

摘　　要：根据马克思经济学地租理论、合约理论和项目管理理论,研究农地流转"三权分置"的有效实现形式和农村集体经济制度的经济特征,提出"三权分置"对应的地租结构,即农民集体土地所有权收益形式的绝对地租,农户承包权收益形式的级差地租Ⅰ,土地经营权收益形式的级差地租Ⅱ。在分析企业农地流转实践典型案例的基础上,提出运用"地租配置"原理,即绝对地租对级差地租Ⅰ和级差地租Ⅱ具有一定替代作用,以实现长期保持企业土地流转租金在较低水平,从而稳定企业农地流转合约;企业向农民集体经济组织进行公共福利和公共建设投资,使农民获得绝对地租性质的社会保障性收益,换取农民同意长期保持较低土地流转租金。通过"地租配置"和提高农民生产性努力,实现企业农地流转合约稳定。According to the land rent theory of Marxist economics, contract theory and project management theory, the effective realization form of ’Separation of Three Rights’ in rural land transfer and the economic characteristics of rural collective economic system was studied, and the land rent structure was put forward corresponding to ’Separation of Three Rights’, that is, the absolute land rent in the form of incomes from farmers’ collective land ownership, and the differential land rent Ⅰ in the form of income from farmers’ contract right,differential land rent Ⅱ in the form of incomes from land management right. Based on the analysis of typical cases of enterprise rural land transfer practice, the principle of ’rent allocation’ was put forward, that is, absolute land rent could replace differential land rent Ⅰ and differential land rent Ⅱ, so as to maintain the enterprise land transfer rent at a low level for a long time, so as to stabilize the enterprise rural land transfer contract;enterprises invest in public welfare and public construction to farmers’ collective economic organizations, so that farmers could obtain social security benefits of absolute land rent in exchange for farmers’ agreement to maintain low land transfer rent for a long time. Through ’rent allocation’ and efforts to improve farmers’ productivity, the stability of enterprise agricultural land transfer contracts could be realized.
