现代武装冲突中混合战争模式合法性问题初探--以俄罗斯混合战争理论与实践为例

摘　　要：随着科学技术的高速发展和国际社会和平意识的普遍觉醒,现代武装冲突的形态也发生着巨大的变化——传统战争正逐步演化为界限更加模糊、方式更加融合、手段更加多元的混合战争。这种常规与非常规作战方式组合运用的新型战争模式模糊了武装冲突的界限,混淆了战斗员与平民的身份,造成了传统武装冲突法的适用困境。面对混合战争与传统武装冲突法之间的冲突,为避免武力滥用和人道主义灾难等严重后果,研究混合战争本质属性与法理冲突,防止过分追求军事目标,正是武装冲突法创新发展的当务之急。With the rapid development of science and technology and the universal awakening of peace consciousness in the international community,modern armed conflict is also undergoing a great change in its form:traditional war is gradually evolving into a hybrid one with more blurred boundaries,more integrated methods and more diversified means.The combination of conventional and irregular fighting methods blurs the boundary of armed conflict,confuses the identity of combatants and civilians,and causes dilemma in the application of traditional law to armed conflict.Facing the conflict between hybrid war and traditional law governing armed conflict,and in order to avoid serious consequences such as abuse of force and humanitarian disasters,this study looks at the nature of hybrid war and conflicts of legal principles and maintains that preventing excessive pursuit of military objectives is the top priority for the innovation and development of the law on armed conflict.
