摘　　要：同一违法行为同时触犯多项水法律规范,法条间形成竞合关系,需依据竞合条款进行裁量。在行政执法实践中,可结合具体案情,引入专业技术论证报告,依法、科学甄别证据;通过评价违法行为造成的影响,合理确定处罚裁量基准,从而精确适用法条,防范执法风险,提高水利部门全面依法行政的能力。The same illegal act may violate a number of water norms at the same time,resulting in a lawful concurrence,and discretion should be exercised correctly.In the practice of administrative law enforcement,professional and technical demonstration reports may be introduced in combination with specific cases to screen evidence scientifically according to law.By evaluating the impact of illegal acts,the benchmark of punishment discretion can be reasonably defined,so as to accurately apply the law,prevent risks,and improve the law enforcement capability of the water administrative department.
