我国长期护理保险制度法定化研究

摘　　要：随着我国失能老年人数量不断增加,失能护理已从家庭个体需要逐渐转变为社会共同需要。2016年以来,我国长期护理保险制度的国家顶层设计以政策形式推进和实施,从权力规范和权利保障角度来看,其有待上升为法律制度。借鉴美英德三国实践经验和结合我国实际,我国长期护理保险制度的法律属性应定位为隶属于社会保障法的社会保险制度,参照互济型制度模式,长期护理保险应作为我国社会保险的第六大险种。在具体法定化路径方面,我国应在统筹社会保险全面立法背景下,单独创设《长期护理保险法》,对有关基本制度进行创设性立法,对有关辅助制度进行授权性立法。在具体制度方面,我国应进一步扩展参保人群和保障人群,强调政府筹资责任,合理确定个人付费事项,突出居家护理形式,细化认定标准规范,强化护理基金和服务市场监管。Based on the fact that the number of disabled senior citizens in our country keeps constantly increasing in recent years,disability nursing has gradually changed from individual family needs to social needs.Since 2016,the national top-level design of domestic long-term nursing insurance system has been promoted and implemented in the form of policies,from the perspective of power norms and rights guarantee,it needs to be upgraded to a legal system.Drawing on the practical experience of America,Britain and Germany and combining the reality of China,the legal property of domestic long-term nursing insurance system should be positioned as a social insurance system under the social security law,referring to the mutual-benefit system mode,long-term nursing insurance should be the sixth type of domestic social insurance.In the aspect of specific legalization path,our country should set up long-term nursing insurance law separately under the background of overall legislation of social insurance,and carry out creation legislation on the basic system and authorization legislation on the auxiliary system.As for the specific system,our country should further expand the number of insured and guaranteed groups,emphasize the government’s responsibility of financing,reasonably determine the personal payment matters,highlight the form of home nursing,refine the identification standards and norms,and strengthen the supervision of nursing funds and service market.
