摘　　要：我国体育产业正在迅速发展,作为一项经济产业,体育产业的良好市场秩序及有效竞争离不开素有"经济宪法"之称的反垄断法的规制与保障。但我国体育产业起步较晚,有关垄断与反垄断问题的研究还比较缺乏。借鉴发达国家的有益经验是促进产业健康发展的有效途径。发达国家的经验表明,体育产业特殊性需要反垄断法特殊对待,体育产业反垄断法规制具有阶段性,体育产业的反垄断法规制具有必要性和不可替代性等特点。China's sports industry is developing rapidly.As an economic industry,the good market order and effective competition of sports industry cannot be separated from the regulation and guarantee of anti-monopoly law,which is called economic constitution.However,China's sports industry started late,the study of monopoly and anti-monopoly problems is still relatively lacking.Drawing lessons from the experience of developed countries is an effective way to promote the healthy development of industry.The experience of developed countries shows that the particularity of sports industry needs the special treatment of anti-monopoly law,the regulation of sports industry anti-monopoly law is periodic,and the regulation of sports industry anti-monopoly law has the characteristics of necessity and irreplaceability.
